Pennsylvania Democrat Philip J. Berg, who filed a lawsuit demanding Sen. Barack Obama present proof of his American citizenship, now says that by failing to respond Obama has legally "admitted" to the lawsuit's accusations, including the charge that the Democratic candidate was born in Mombosa, Kenya.

As WND reported, Berg filed suit in U.S. District Court in August, alleging that Obama is not a natural-born citizen and is thus ineligible to serve as president of the United States. Though Obama has posted an image of a Hawaii birth certificate online, Berg demands that the court verify the original document, which the Obama campaign has not provided.

Now Berg cites Rule 36 of the Federal Rules of Civil Procedure, which states that unless the accused party provides written answer or objection to charges within 30 days, the accused legally admits the matter.

Since Obama has only filed motions to dismiss and has not actually answered the charges in the lawsuit, Berg claims, according to Rule 36, Obama has legally admitted he is not a natural-born citizen.

Now Berg is asking the court for a formal declaration of Obama's admission and asking the Democratic National Committee for another presidential candidate.

In a statement released today, Berg argues that he filed Requests for Admissions on Sept. 15, 2008, meaning Obama had until Oct. 15 to answer or face the consequences of Rule 36.

"Obama and the DNC 'admitted,' by way of failure to timely respond to Requests for Admissions, all of the numerous specific requests in the Federal lawsuit," Berg's statement reads. "Obama is 'not qualified' to be president and therefore Obama must immediately withdraw his candidacy for president and the DNC shall substitute a qualified candidate."

Berg's original lawsuit leveled several charges at both Obama and the DNC – accusing the former of lying about his place of birth, faking his birth certificate and fraudulently running for office; and accusing the latter of not properly vetting its candidate.

Though it hasn't given Berg the evidence he seeks, the Obama campaign has publicly answered allegations that the candidate was born in Kenya and faked his Hawaii birth certificate.

"Smears claiming Barack Obama doesn't have a birth certificate aren't actually about that piece of paper," says the "Fight the Smears" section of Obama's website, "they're about manipulating people into thinking Barack is not an American citizen.

"The truth is, Barack Obama was born in the state of Hawaii in 1961, a native citizen of the United States of America," the campaign website states. It also includes images of a Hawaii birth certificate bearing the name Barack Hussein Obama II.

Berg has also taken the controversy public through his website and through repeated public offers to revoke the lawsuit if Obama will produce legal citizenship-establishing documents.

Without those documents, Berg has chosen to file two additional motions in district court in Philadelphia. The first asks the court to notify Obama and the DNC of what Berg understands they have now legally "admitted," and the second asks for an expedited ruling, given the quickly upcoming Nov. 4 election.

"It all comes down to the fact that there's nothing from the other side," Berg told Jeff Schreiber for his blog, America's Right. "The admissions are there. By not filing the answers or objections, the defense has admitted everything. He admits he was born in Kenya. He admits he was adopted in Indonesia. He admits that the documentation posted online is a phony. And he admits that he is constitutionally ineligible to serve as president of the United States."

So we're being held hostage then? Why are Americans and the media so afraid of this guy? Is it because he's black? Is it because we're afraid of muslims who support him? Let his supporters have a temper tantrum and riot, it's better than tucking our tails and bowing down to fear. I've heard a lot of stuff that suggests strong arm tactics being applied and if we don't stand now, we'll loose our country and what it has always stood for. I can't believe the pansy attitudes, we're setting ourselves up for a loss of the freedoms our country was founded on and soldiers have died for. Sick!

Why am I not hearing coverage about this on other news media? I haven't even heard it on Foxnews. Doesn't the Dems care about truth or law anymore? Why are the courts not forcing this issue to be dealt with prior to the election? Who in the mainstream media or court system can help? This stinks to high heaven.

I am still amazed that the Media has totally ignored this question. If Obama was Republican, the media would have rooted out the answer to this question a long time ago, but since he has the "proper" ideaology, he gets a pass. Palin gets investigated clear back to her birth, but Obama is asked no questions at all. Is the gap between liberals and conservatives widening to the point of a "civil" war? What will end it?

Oh yeah? Then where is his birth certificate? It's a very basic document and is required in many situations here in the US. It's very easy to obtain. I have requested and gotten my birth certificate many times over the years. Some of his Kenyan relatives say they were present at his birth in Kenya.

If bHussein Obama will lie about one thing he will lie about anything. He is like a lot of blacks (half black) laws mean nothing unless they are for the black.

The requirement is that Military "brats" have to be born on a federal reservation (base). I was still required to provide proof of the birth on a base to apply for my daughter's citizenship.

3 predictions if Obama becomes President (God forbid)

Its quite obvious that Barack Obama is a racist and hates all White people as does his wife Michelle. With that being said, and with the 99.9999% chance he was born in Kenya maybe it would be wise for him to move himself and his family to Kenya where he belongs. He is certainly not qualified in all respects to be Presidernt of the United States.

If he does become our next president, I have three predictions. Prediction #1 (you will see all those tax cuts dollars that are suppose to go to the 95% of the people will end up in his pocket and the rest of the low life Black people will still be in the same position they are now).

Prediction #2 (Barack Obama is planning to reverse the status of the American people....the white people will become the lower class while he will elevate the status of the Black people.

Prediction #3 (If Barack Obama is elected as our next president, everything we have accomplished in the last 200+ years will be destroyed and America will no longer be OUR COUNTRY. It will no doubt become the "United States of the Islamic Nation."

Therefore, if he really was born in Kenya or anywhere else outside of the United States, he is not by law allowed to run for the office of President of the United States. Lets force him to produce a valid birth cerfificate as well as all of his medical records. If he refused, then he should immediately be disqualified and removed as a presidential candidate.

You begin your argument by presuming that which is to be proven. You also incorrectly assume that being born to us citizens abroad satisfies the question of "natural born" or words to that effect in the US Constitution. McCain, who was born abroad to a serving US Naval Officer, qualifies by the dual virtues that the Panama Canal Zone was US administered and that his father was a serving US officer.

If this is no big deal, why is the O campaign stone-walling? McCain went through all this some number of months ago. If Obama was truly born in Hawaii, there would be ample corroborating evidence available to anyone interested in investigating. At this point, allowing that investigation to occur would be the best thing for the nation.

A man who will deliberately deceive you regarding something as cut and dry as place and time of his birth ought not be able to count on your support in important matters. Remember Biden warning us all that we would not be sure your boy will be doing the right thing once the Russians, er, I mean the international community, test him in the first six months of his term.

However, rather than produce the demanded documentation the Obama campaign seeks only to dismiss the lawsuits. Wouldn't it be simpler to provide said documentation, prove Berg a nutcase and be done with it ?

It is my understanding that if Barry was adopted by a citizen of another country and lived outside of the US, then subsequently does not apply for naturalization after he returns to the US, he would still be ineligible to run for the office of POTUS even if he were born in Hawaii.

This has been verified numerous times, by various sources, as legitimate. The federal elections board, Illinois elections board, DNC, RNC, and the State of Hawaii have all checked and re-checked and found him to be a natural-born American citizen. Do people really believe that were he not, that McCain, the GOP, Hillary, etc., would NOT have challenged his status as a citizen?

Yet somehow, speculation from one Democrat in Philadelphia is more valid than all that. I swear, Jesus Himself could present a certified DVD of Obama's birth and people still wouldn't believe it because they got an anoymous forwarded email telling them what they want to hear.

This issue has been swirling for months and months. All Obama has to do is produce the LEGAL documents and all will be put to rest. The Obama campaign and the DNC can do nothing but go to court to try to squash any attempts to produce these documents. One has to ask WHY? Only a guilty or less than honest person would not want to produce the documents and quiet the other side for good. When John McCain's citizenship was questioned, he produced the documents immediately and it was a mute subject. Qualifications for POTUS are supposed to be full disclosure, why does Obama think he is excused from the rules?

V: YOU'RE CORRECT in your assessment of the potential for rioting to occur if Comrade Senator Obama is disqualified by proof of fraud regarding his non-US birth. His Kenyan relatives are probably correct, but I predict their life spans will suddenly come to an end there in Kenya, thus eliminating further embarrassment to our coming political messiah. But, as I've said before, if the mouth breathers that choose to support this disaster choose to riot, then bring it on, baby. Fear not.

I have to consider that the world has been sent a "strong delusion" according to what the Bible says in either 1 Thess. or Revelations. This may be the end-times unfolding before our eyes. Because of the much wanted "change" that Obama will bring - we may need to consider the scenerio of "change"-we now have an abundance of food, we may not with "change"; we have the best health care in the world, we may not with with "change"; everyone I know has a good job, with "change", jobs may be scarce; we have some cash in the bank, Barak may "change" that; our military is the best in the world, after "change" we may be crushed. We now feel safe knowing we can protect ourselves with our guns, Barak will definetly "change" that. We now can speak truth on the airwaves through TV and radio, not with Obama's "change", remember the "Fairness Doctrine". The cries of "change" is reminiscent of the cries of "Heil Hitler".

I Agree and Don't know why the GOP has not pushed for proof of his citizenship. It's not Race but the law,So do the Democrats do their usual if the the law don't fit they just bend it or find a judge to get rid of it....

It is very clear that Obama has not been vetted by the main-stream media. They ask about Palin's qualification to be president and investigate every little piece of supposed "dirt" they can find but NEVER ask this about Obama. Biden even said Obama was not qualified to be President! The only reason Obama is ahead in the polls is because of the main-stream medias cover up and devotion to Obama. It is nothing new. Look at all the socialist countries in the world (Venezuela, Korea etc.) and you will see the same manipulation of the media. The people that work for the main-stream media have drunk the Obama Kool-Aid. They will regret it.

As a matter of fact, there is no evidence in public domain that certifies Obama was born in Hawaii. The birth certificate he had posted originally on his web site was a copy of a fraudulent one posted by "The Daily Kos", the communist newspaper for America.

When the controversy got hot over that one, he had a facsimile of a Hawaiian certificate posted, however it is not an official certificate without the state impressed seal, something not verifiable via the web.

As a former Marine Recruiter, it takes five dollars, the signature of the person in question, and two weeks at the most, for a certified copy of any valid birth certificate to be obtained at any time. Obama has not filed a certified copy of his certificate to this date, and there is no valid reason for this.

There is sufficient evidence to call his birth into question, his mother was not old enough to provide citizenship absent an American father. Kenyan relatives have made official statements as to his birth there. His adoption by his stepfather, in the absence of an American birth certificate made him an Indonesian citizen, and thereby illeligible.

He did not have to produce it to be a state senator, it is not a requirement. He did not have to produce it to be a National senator, it is not a requirement for that seat either. It is only the President and Vice President who must be Native born citizens, and so this is the first time it is an issue, legally, for Obama.

So far, the only "verification" made in public of his posted birth certificate was made by a company with ties to ACORN. No government agency has certified it as true, and until such happens, he is ineligable.

That certificate has a number of serious questions about its validity. Where is evidence of the embossed seal for starters? It is nowhere to be found. And the term "African" is incorrect... should be either Kenyan or negro (term used until 1980).

To this point, I have not heard this covered on radio or TV and it is quite alarming.

I think the guy would fail the test if held to it by some authority.
